Who we are
This website, https://ngocsenviet.com, and the LUMANCE store are operated by LUMANCE (“we”, “us”, “our”). These Terms & Conditions apply to everyone who browses the site or places an order. By using the site or ordering from us you accept these terms; if you do not agree with them, please do not use the site.
Eligibility and accounts
You must be at least 18 years old to place an order. You agree to provide accurate billing, shipping and contact information and to keep it up to date. If you create an account you are responsible for keeping your password confidential and for all activity under the account. Tell us immediately at support@ngocsenviet.com if you suspect unauthorised use.
Products and pricing
All prices are shown in U.S. dollars (USD) and exclude shipping and any applicable taxes or duties, which are shown at checkout or charged by customs on delivery. Product descriptions, prices, availability and promotions may change without notice. If we discover an obvious error, for example a clearly incorrect price, we may cancel the affected order and refund any amount paid.
Our products are cosmetics intended for external use. Nothing on this site is medical advice, and no product is intended to diagnose, treat, cure or prevent any disease. Read the full ingredient list before use, patch test new products and stop using a product if irritation occurs. Contact support@ngocsenviet.com if you have ingredient questions before ordering.
Orders and payment
When you place an order you are making an offer to purchase. We accept the offer when we send the shipping confirmation; until then we may decline or cancel an order, for example because of stock, payment, fraud-screening or sanctions-compliance issues, and any payment already taken will be refunded. Payment is taken in full at checkout through the payment methods displayed there. Each order is limited to 5 units of any single product.
Shipping, returns and refunds
Shipping destinations, rates and delivery estimates are set out in our Shipping Policy, and the return window, conditions and refund timing are set out in our Returns & Refunds Policy. Both policies form part of these terms.
Sanctions and export controls
LUMANCE complies with U.S. economic sanctions and export-control laws administered by the U.S. Department of the Treasury (OFAC) and the U.S. Department of Commerce. We do not sell or ship to countries, regions or persons subject to U.S. sanctions or embargoes, including Cuba, Iran, North Korea, Syria, Russia, Belarus and the Crimea, Donetsk, Luhansk, Zaporizhzhia and Kherson regions of Ukraine, or to anyone on a U.S. restricted-party list. By ordering you represent that you are not located in, ordinarily resident in or acting on behalf of a sanctioned country, region or person, that you will not re-export our products in violation of applicable law, and that the shipping address is not in a restricted destination. We may cancel any order and refuse service where a sanctions or export-control concern arises. The destinations we cannot serve are excluded from the country selector at checkout.
Acceptable use
You agree to use the site only for lawful personal shopping. You may not resell our products commercially without written permission, interfere with the operation or security of the site, scrape content, place fraudulent orders or use another person’s payment details. We may suspend or close accounts that breach these terms.
Intellectual property
The LUMANCE name, logo, product names, photographs, text and design of this site belong to LUMANCE or its licensors and are protected by trademark and copyright laws. You may not copy, reproduce or use them without our written permission, except to browse and shop on the site.
Disclaimer and limitation of liability
The site and products are provided “as is” to the fullest extent permitted by law. We do not guarantee that the site will be uninterrupted or error-free. To the extent permitted by applicable law, our total liability for any claim connected to an order is limited to the amount you paid for that order, and we are not liable for indirect, incidental or consequential losses. Nothing in these terms limits liability that cannot be limited by law, including liability for death or personal injury caused by negligence, or your statutory consumer rights.
Governing law and disputes
These terms are governed by the laws of the State of California, USA, without regard to conflict-of-law rules, and any dispute will be brought in the state or federal courts located in California, except where mandatory consumer-protection law in your country of residence gives you additional rights. Before starting a formal dispute, please contact us at support@ngocsenviet.com; most issues can be resolved quickly by customer care.
Changes
We may update these terms from time to time. The version published on this page at the time you place an order applies to that order.
